3D Realms Not Dead, Says Lawsuit Is Bullying

Always bet on Duke? Apparently. In response to the much-publicized lawsuit that Take-Two filed against the remnants of 3D Realms, the company has issued a press release explaining their situation.

Quote:
Despite rumors and statements to the contrary, 3D Realms (3DR) has not closed and is not closing. 3DR retains ownership of the Duke Nukem franchise. Due to lack of funding, however, we are saddened to confirm that we let the Duke Nukem Forever (DNF) development team go on May 6th, while we regroup as a company. While 3DR is a much smaller studio now, we will continue to operate as a company and continue to license and co-create games based upon the Duke Nukem franchise.

[...]

Less than a week after the DNF team was released, Take-Two filed its lawsuit in New York, seeking immediate temporary injunctive relief. The court denied Take-Two's request for a temporary restraining order. While we cannot comment on the details of the ongoing lawsuit, we believe Take-Two's lawsuit is without merit and merely a bully tactic to obtain ownership of the Duke Nukem franchise. We will vigorously defend ourselves against this publisher.
It seems this soap opera has a few more episodes.

Well, as long as it's not on Valves HL2 Episode release schedule, we should see it soon!

Also, another interesting tidbit:

Quote:
For fans of the game, however, there's still hope: 3DRealms has been ordered to appear before a New York State Supreme Court judge on June 11 to argue why the judge should not order 3DRealms to turn over the Duke Nukem Forever source code to Take-Two, as the company has apparently asked the judge to do. The proposed order was part of the Take-Two suit.

3DRealms, just die already. You people obviously don't know how to run a company and develop a modern game. Please stop wasting time and money.

It seems like quite a few people actually want to see this game completed and released. I just can't imagine how it could possibly be good at all. Its been in the oven far too long.

Even though it is fake, the idea of DNF being made by Valve is an awesome one.

It would be nice to see the Duke ownership handed over to a competent developer. I'd like to play a new Duke game before I die. Ha.

Either gamers want a game ASAP, and they call it rushed crap, or gamers cry when a game doesn't get released (or delayed). Either way, 3D Realms is a fine company. But the DN IP is so big that a proper sequel was made sure to be done properly. They have the right to not release a game if they think it's crap. Seriously, these guys don't need to be given shit. If it was purposely a scam, then good for them for getting away with it. Any business dealings with money are pretty extensive, I'm pretty sure any investors/publishers saw what was going on.

Sorry about the fake-out guys. A friend saw the BBspot, spot, and then I saw this. :-)

I know when I saw Valve picked up the Duke IP... *I* was very happy... though, I DO remember the wait on TF2... :-) Lets see, I saw the original TF2 tech at E3, the same year Sierra showed off Babylon 5... which one finally reached release. :-)

12 years. There has to be a point that you cross when you just say...enough is enough. When you read 12 years you think "yeah that's a long time". The other day however I actually though about how long 12 years is, and it shocked me that they could just keep delaying it.

I don't need to have a game released ASAP. I've been waiting for Starcraft 2 and Diablo 3 for years, and rather patiently at that. I'm waiting for the next Half Life and Elder Scrolls just as patiently.

12 years is joke, a pathetic joke, it's been in development for half my life, I've been through high school and University. Is the Duke Nukem franchise even that big anymore?

You can do a game properly in 5 years. If it takes 12, its because you are incompetent. Even the masters of delayed games - Valve and Blizzard - still manage to turn around a game in 5 years. And not one of their sequels has ever been said to not do justice to the original IP. Were Diablo fans crying when Diablo II was released? No, they were f'ing happy. If Blizzard can do it, why cant 3DR?

I'll tell you why, you need to actually be competent to produce a game. 3DRealms management strategies worked fine on a small project with a small team like DN3D, but the modern world is a different beast when it comes to development.

They don't have the right to piss away years and millions of dollars of another company's money, especially when they think they can just walk away with everything they've made and no obligations or responsibilities.

They deserve to be given shit for dragging this out at least six years longer than it should have been going on. They're such a great development team and 'fine company' then they'd have released SOMETHING at some point.

You'd honestly cheer them for scamming millions off Take Two then not delivering a game to all those devoted fans they've been leading on? Pretty weak.

Even if the investors were stupid enough to keep investing, it doesn't make it any less wrong. Take Two has obviously wisened up to their bullshit but that wont recover any losses.
