Double Fine Fights Back



Brutal Legend developer Double Fine has made the next move in the continuing battle between the studio (along with their current publisher Electronic Arts) and the game's former publisher Activision. Last week, Double Fine filed a countersuit againt Activision, contending that Activision's initial lawsuit was filed with the intent to directly harm Double Fine and the release of Brutal Legend, currently scheduled for October 2009.

In a statement release by Double Fine, CEO Caroline Esmurdoc writes, "Now that we've found a publisher and the game is getting sensational coverage, they want to stop its release. Double Fine's countersuit is a demonstration of our intention to fight for this game - Activision will not kill 'Brutal Legend.'"

fuck yeah Double Fine. I'm not sure EA is any less evil than Activision, but in this case I'm with EA all the way. Activision didn't do shit with the game and now that EA put the marketing money behind it and it's getting hype, they pull this crap.

I really can't understand Activision thinking they have any claim over their cast-offs, and it's nice to see Double Fine fighting back. Right on.

Beyond the typo (publister), that just isn't reading quite right for me. I understand the difficulty in having to list three parties in the suit, but I don't think you'd usually write, "the battle between A versus B."

If I could make a recommendation, perhaps the following or something like it would work better:

Good on them! On a similar note, I am fucking stoked about playing this at Comic Con. I am pretty much just going this year to play Brutal Legend. Hopefully Tim will be around.

The only way you would know who was right or wrong would be if you're a judge and you are the one hearing both companies arguments.

If not then you don't know... just like every other poster here.

Are we talking about the same Activision that tried to keep me from using the Guitar Hero guitar I bought from them with Rock Band? That certainly predisposed me towards trusting them.

I'm curious to know what leads you to this conclusion.

And I'm not so much a fan of Double Fine as I am of the guy who gave us Grim Fandango.

I don't see how this is really an assumption.

1. Activision dropped Brütal Legend because they couldn't exploit the IP. Result: no release.

2. Activision is trying to keep EA from releasing the game. If they get what they want: The game gets put on hold until they're done doing what ever the fuck they're doing. Result: no release this year.
