No, probably not in this instance. EA had a fiduciary responsibility to their shareholders to compete for that contract. Not attempting to get the exclusive rights would have opened them up to a lawsuit from their shareholders given how important the Madden franchise is to their profits.

And at what level do you judge complicity? Is 2K Sports complicit for submitting their bid as well? Should they be held accountable along with EA? Supposedly five publishers bid on the rights, and EA won. So are all five of the bidders complicit, or only the company that won?

And if you think the "but ... shareholders!" thing is gonna fly with me you're mistaken.

So you think EA should be punished for winning the bid on exclusive rights, but everyone else who bid, but didn't win, should get a free pass? And the company actually committing the antitrust should be left out of the suit because they'll probably win anyway? I simply don't understand that argument.

Basically, what you're saying is that anyone who subscribes to cable television and/or Internet service is complicit in the antitrust practices of the cable providers and are open to lawsuits? Sweet. As a DirecTV subscriber, I'm safe, and apparently need to talk to a lawyer.
