Microsoft May Be Banned From Importing, Selling Xbox 360's in the U.S.

Citing infringements on Motorola patents, International Trade Commission Judge David Shaw has recommended a ban on imports of the Xbox 360 in the U.S.

The ban would apply to the 4GB and 250GB versions of the console, which are made in China.

The judge also advised against the sale of machines already in the states, and recommended that Microsoft should post a bond equal to 7% of the value of unsold Xbox 360's in the United States.

This all stems from a Microsoft v. Motorola suit that began in 2010. The specific patents in question revolve around how the Xbox 360 decodes video content.

From here, this goes to the ITC commissioners.

If the commissioners stand by Judge Shaw's determination, the issue heads to President Obama's office, which will have 60 days to review the recommendation.

If there's no movement after 60 days, the only recourse for Microsoft would be via the Court of Appeals for the Federal Circuit.

Doing a quick Google search (oh, the irony in that), no, they're not. It would actually be a more realistic proposition to think of the opposite happening. Either way it would be terrible.

MS buying Google is just a silly notion. Now that Google bought Motorola though, I think this issue will probably be fought even more fervently as Microsoft has been trying to hinder Google for a long time. This could be an interesting slap fight.
