Fellow CoGgers, I am at an impasse. I have been accepted to a summer research program at school this year. My proposal is quite simple; I must write a chess engine, and give it an interface geared toward teaching chess, particularly wordlessly so that literacy does not affect its usefulness. This stuff I firmly believe I can handle.

Incidentally, the project is required to be open source. What this means: By tomorrow, I have to have a web presence for the project, namely a blog, wiki and project hosting. I firmly believe I can handle these tasks as well.

HOWEVER, in order to complete them, I need to have a name for the project. I have none. This is where you come in, CoG: Help me name my project! Since it's academia type stuff, it definitely needs to have a punny name (This is a real trend, you know), but that is the only real requirement outside of the name fitting

If there's more than one suggestion, in six hours I will put up a poll between them. Thank you in advance, CoG!

But honestly I just got lucky. Was just running through things in my head trying to find a connection between open and chess and stumbled on to it

The name OpenGambit is already in use, (http://www.opengambit.com/cms/) if such a thing matters to you.

I did google for it and found that, but I am admittedly a touch unconcerned. It's a miniature company from hawaii with next to zero web presence, and which hasn't touched its website since last year and may well never touch it again. If I get C&D'd or something, I'll just come back here for a different name. But I don't really expect that to happen. After all, my chess program is for the good of the world, definitely not for a grad school application, so, you know, karma says I win.

Also, it is completely unrelated to chess. Since the two "Open Gambits" are so dissimilar, you would likely be able to keep the name even if they complained about it.

Generally speaking (IANAL of course, and this is just from admittedly shoddy memory), the criteria by which trademark cases are judged are in no particular order: 1) Potential for confusion among customers/clients, 2) Type of business (or business domain), and 3) Region. I personally wouldn't expect the type of software involved to matter very much; rather, they're both in the general domain of software/information technology, so the overlap is rather significant.

All that being said, I don't see any evidence that they've registered OpenGambit as a trademark, and there is some question as to how active that particular business is. It's probably not really anything to worry about, but I thought it best to at least inform him. :)

It could conceivably be judged that the overlap is significant, but as one of them works on developing IT solutions and one is a chess tutor, the reality is that the overlap would be pretty trivial. No one who is looking for IT help is going to be confused by chess software, and vice versa.

Regardless, the company seems small enough that there likely won't be any concern.
